i got married in 2011. it was arrange cum love marriage. in 2012 i delivered a baby girl. according to his tradition, first baby should deliver in my parents home. so i went my parents place. then after 6 months when i came back, my husband is not talking with me. when i call or message, he abuse me. and his parents said that its your life we can't do anything. when i asked for some rupees for me and my baby, they refused to give me. me and my baby are living alone and he is not taking his responsibility. please help me what i do.

contact local alwyer and file complaint under DV act . you are entitled to stay in sharedhousehold and can ask for maintenance . you cna laos seek alternative a ccomodation

Try to resolve the matter with the intervention of common relatives and if no solution arrives then contact a lawyer and file DV Act application, 125 criminal procedure code petition and if arises then 498a IPC case.

Going for mutual settlement is first option. If it fails then you can go to court and get maintenance for yourself and the child.

hi...
as i posted my query. all my family members tried to solve. but no solution. now he is blaming me for everything. and he is trying to insult me infront of my family. he is telling lie. he is saying this was your decision of marrige and baby. and as i said earlier it was love cum arrange marige. iam from uttar pradesh and he is gujrati. now we are feeling that we are cheated. now i am living ahmedabad. my family lives very far from me. no one is there for helping me. how can i go with my 5 months daughter. please suggest me some simple way..

simple solution is to contact local lawyer in ahemdabad . file DV complaint and ask for maintenance , right to stay in house .

i would like to know that should i file a case for maintenence now or i should wait for some time. my baby is 6 months old now. things are not going good. my parents talk with his parents also but no solution. please suggest me wait is in favour of me or not??

You and your daughter both are required to immediately file for the maintenance. This is your legal right and there is no need for waiting.

hi,
As i wrote earlier my case, my husband is doing business of embroidery designing and i m an interior designer. earlier i used to work in office and also did projects. my husband took loan for his business.n if i start my work again, then he would give us maintenance. he can say that my business is not doing good. would it consider if i work from home?? if he is in debt.. he is legally eligible for maintenance?? now he wants my baby. can he take custody of baby?? if he prooves some false things then... please help me.. he is warning me by messages. he is herrasing me mentally.

YOU SHOULD FILE SUGGESTED CASES WITHOUT WAIT AS WAIT WON'T HELP YOU.
DON'T ADMIT YOU KNOW SOME ART WHICH CAN FETCH INCOME FOR YOUR MAINTENANCE.
BASIC MAINTENANCE IS YOUR AND YOUR CHILD'S RIGHT,NO MATTER HE IS RUNNING IN DEBT.

Hello,
My problem yet not solved. But one positive thing is my husband is now started to give me nominal amount of money.
My in laws lives in a village. My husband forced me to live there. I went there in January and started living. There my in laws herrased me mentally. My husband abused me in front of all his relatives. Next day he dropped me my place.
His father is having property which is earned by my husband's grand father.
I would like to ask is there any share of me and my baby to that property?
How much I can claim for maintenance?
Can I file a case of mentally her easement?

You or your baby have no right to demand share in the house purchased by the grand-father of your husband at this stage.
Better to file a petition seeking enhancement of the amount of maintenance.

neither you nor your child have no right on your husband grand father property . we have already advised you to file DV case seeking right to stay in matrimonial home or alternative accommodation . in addition seek maintenance for your child
