Non attendance(section 138) at court

Hi !!!!!

My father has been filed under Section 138.Due to health issues he has not been able to attend any of the meeting dates given by the court.Now if he goes there will there be a Search Warrant issued ????

Your advocate could have filed exemption application. Now also your advocate can file bail application, if bail is not yet taken. If bail is taken then warrant recall application.

The health condition could bementioned in the absent petition by your advocate.But if the complainant objects warrant can be issued.Go as per the advice of your local advocate.
