Damage suit

sir , my friend has been running a kirana shop since ten years .one day unexpectedly current service wire was short circutted due to negligence of current dept.for that negligence my friend shop and other houses were damaged and our shop worth was 7 lakhs only and F I R WAS registered on same day (i.e 21-9-2009).we aproched current dept and lodged the complaint to the collector anr R D O.THERE WE ARE NOT GET ANY RELIEF and compensation. NOW WE WANT to aproach the hon'ble court.we want to file a damage suit on current dept.PLSexplain the procedure and sections for recovery of damage. thanking u sir.

You can file suit for damages. If it is negligence then you can also file consumer complaint.

YOU have both options as told.Of suit or of consumer complaint provided you have authorized connection and have evidence to prove the negligence of the department concerned.

consumer complaint would prove a better as it is cost and time effective.

First issue a legal notice with help of a lawyer then file the complaint.

You file consumer forum+ civil suit for damages.issue legal notice demanding damages, and ait for 15 days , if reqd u/s 80 cpc , 2 months.
