Divorce query.

Hello.

I was applied pitiion last year June,2010 against my wife in nadiad, gujarat on crulty basis and mentally harrasment to my family and me. Actually i have alreay separate from my wife more than one year and then file the above pitition. she slapped to my mom and give metal harressent to my family.
She are not attending hearing regular basis and i got only date of this case.Also her Advocate is not come to court last five hearing just last hearing came.

Now she file another case under section 9 and section 125 in Ahmedabad family court.

Please give advise what i am doing now.

I want divorce from her.

if your wife dosent want divorce from you it will be a contested matter . it may take time for case to be disposed of . draw the attention of court to fact that wife and her advocate has remained absent for 5 consecutive dates . request court to grant her last chance for filing reply etc depending upon the stage your matter is at present .

contact a local lawyer for 125 case and section 9 case

In any case, to contest the case on its merits is the only way out for you.

I hope you filed the divorce petition through a lawyer. If yes, he can help you in the matrters filed against you too.

You have no option but to contest the case u/s 9 HMA or 125 crpc.

The divorced case and the RCR is supposed to amalgamated for analogous hearing.

thanks to everyone for give me reply.

I understand what you all are telling to me.

But,from the beginning of the marraige she given lots of trubble to me even though she four slapped to my mom and for her mental tourchering to mom and my mom in frustration.

First i was filed against her in June,2011 after passed more than one year and She filled pition against me for marriage rights under section 9 and 125 as per marriage act in Ahmedabad.

I want to divorce by anyway.

I hope you give me best advis for solve this issue.

I also getting the support from my lawyer.

You have very well have been advised in the given facts. Nothing special has been told by you in your subsequent posting. You shall have to contest all cases. Your case shall benefit you in the subsequent filed cases by your wife.
