2 questions on rti act 2005

Querist : Anonymous (Querist) 22 September 2011 This query is : Resolved
1) I have sent an RTI application to a bank with my name but forgot to put the signature.
- what happens?

2) I enclosed the Criminal case FIR copy
also with it. I didnt mention any sections or Sub-section of RTI ACT 2005.
- So will it be treated as Life or Liberty request?
Advocate Rajkumarlaxman (Expert) 22 September 2011
without signature and court fee stamp the application would not be valid at all.
Advocate Rajkumarlaxman (Expert) 22 September 2011
what is the criminal case FIR copy. for what you have applied in the bank. and for what purpose you need to mention the sub section of RTI act. application when filed with stamp of court fee Rs.10/- is treated as application under 3[b] of RTI act 2005. it is not necessary to mention. If you mention that it is an application under RTI it is enough.
mahendrakumar (Expert) 22 September 2011
yes, as rightly advised by Mr.Rajkumarlaxman, mentioning of the sections are not needed or important.

However, for authenticity of any application,it should be signed.as such your application is liable to be rejected.

submit a fresh one .
Sailesh Kumar Shah (Expert) 22 September 2011
1. Without Signature, it is not valid.
2. If you are mentioning in application form stating that there is question of the life or liberty of a person. There is no need to mentioned sections.
K.S.Srinivas (Expert) 22 September 2011
Agreed with the above experts.
malipeddi jaggarao (Expert) 22 September 2011
1. Without signature it is not valid
2. Mere enclosing FIR copy will not qualify for supply of information under the clause Life and Liberty. Under this clause the CPIO is supposed to supply information within 48 years if your request substantiates with evidence of life risk in the absence of information. Since your application is not signed bank may not take the request into cognizance.

Please resubmit your application to the Bank with your signature and also with the initial fee of Rs.10/- by way of Demand Draft of Postal Order in the name CPIO....Bank.
Querist : Anonymous (Querist) 22 September 2011
Could you please confirm whether it is by

1) Demand Draft of Postal Order ?
or
2) Bank Draft / Bankers cheque favouring that govt. Bank and payable at the centre
or
3) Non-Judicial Rs. 10/- Stamp paper?
Sailesh Kumar Shah (Expert) 22 September 2011
1) yes
2) Yes
3) No, Non judicial stamp is not acceptable.
Querist : Anonymous (Querist) 23 September 2011
Then for which type of RTIs the
Non-judicial Rs.10/- stamp is acceptable?

Any Idea sir?
Sailesh Kumar Shah (Expert) 23 September 2011
Dear Author
Nowhere is mentioned in the RTI Act,2005 that Rs.10/- Non judicial paper will be accepted as fees.
Advocate. Arunagiri (Expert) 23 September 2011
You said 2 questions on RTI.

Now you are asking Too many questions on RTI.

When the expert says nonjudicial stamp paper is not accepted, once again you are asking in which type of RTI it is accepted.
R.Ramachandran (Expert) 23 September 2011
Dear Anonymous,
Please clarify as to who told you that there are many types of RTI?
Also clarify who told you that RTI Fee can be paid through Non-Judicial Stamp Paper?
Guest (Expert) 23 September 2011
The experts have already stated clearly that non-judicial stamp of Rs.10 is not acceptable with RTI application. If you have any doubt or some information contrary to the advice of the experts, better reply the questions raised by Shri Ramachandran.
