Whether second wife is eligible for family pension? (First wife predeceased husband)This case is pending with me. Please guide.

Dear Mr. Partha, If the person had married for the second time (after the demise of his first wife), the second marriage is valid and consequently, the second wife only be the official wife of the person concerned and she would definitely be eligible for the pension (if as per the pension scheme 'wife' is eligible for pension).

I need citation to submit to the court. Can Mr.Ramu come to my rescue as the issue is related to my own step mother who brought up all the four children of my father since childhood after the demise of my mother at a very young age. My Father who retired as a Senior Civil Surgeon during the year 1993 and died as pensioner on 22.01.2002. My step mother is yet to given family pension as the details of her was not recorded in the service register of my late father. However, legal heirship is issued by the competent authority duly stating that the fact that she is the second wife of my father based on revenue records. Succession Certificate is still pending the Poonamalle Sub Court for more than one year.

If second wife is legal (if married after death of first wife or after divorce) only then she is entitled for maintenance.
