Perjury

Querist : Anonymous (Querist) 19 October 2010 This query is : Resolved
I have documentory proof of a person who committed perjury while purchasing plot from Pradhikaran (Body set up by Govt). I want to complain to Pradhikaran but sure they won't take any action because of the nexus. Can I directly take the matter to the court ? Is there any other alternative ? Pls advise.

I do not think that you are directly involved with that deal. If it is so, then I think you have no locus standi to initiate perjury against that person. In any case false statement in a deed of conveyance does not amount to 'perjury' as it is neither a false statement on oath not made before the court of law.
If you have prima facie proof that there is large scale nexus between the govt. body and private individuals in that type of land transfers effecting the public interest in large then you could file PIL(Public Interest Litigation) before the High Court.

perjury ....deliberate or willful uttering of untruths when under oath in a court or similar tribunal.
RTI IS GOOD ALTERNATIVE BEFORE COURT

Go to High Court and file PIL instead of going to local civil/criminal court.

Thanks !
However, I would like to elaborate more. If a person is already allotted a plot by Pradhikaran no other member from the family can acquire another plot. For this Pradhikaran always obtains affidavit from the applicant that applicant or his/her family member does not posses plot allotted by Pradhikaran. The person I am referring is a lady whose husband is alrady possessing the Plot allotted by Pradhikaran. She applied in her parental name concealing her marital status as well as possession of plot by her husband and submitted notarized affidavit to that effect and got the new plot allotted. Hence the query.

No, i don't Agree the aboves.
Because Such type of the bodies governed by the Urban Planing and development Act of the respective state. And the DM and the Commissioner are the Secreatory and president, respectivly.
if the VC has not take any action against that person you camplaint with the Commisoner with the respective Rules and proof of the previous allotment in her husband name.
