Deduction of insurance claim on account of non spot survey

My vehicle met with an accident,spot survey could not done due to some unavoidable reasons,now insurance co. has deducted 25% amount from net assessed claim amount from my own damage claim case.Is it lawful,kindly help.Thanks

unless the terms of your poilicy say so,it is illegal from company side.

But I am wandering as to how claim was entertained without the surveyor report? Can it be possible to entertain a claim without the Surveyor report? Is Surveyor Report mandatory or only directory?

Spot survey and rough survey are two different things. Only spot survey was not done so claim can be entertained. So far as deduction is concerned, definitely the terms and conditions of the policy and subsequent survey report play vital role so nothing can be commented until all the terms are brought to light.
