bail bonds forfieted

I WAS CHARGED WITH THE OFFENCE UNDER WILD LIFE ACT,I WAS BAILED OUT ON BOND OF RS.50,000.I REMAIN ABSENT FOR 4 HEARINGS CONT. & APPEARED ONLY ONCE.WHEN I WENT ON LAST DT.OF HEARING,MY LAWYER TOLD ME TO DISAPPEAR FROM THE COURT AS THE BAIL BONDS HAVE BEEN FORFEITED.NOW WHAT IS THE REMEDY FOR ME.ALSO THE SURETIES R MY BROTHERS. THE CHARGE IS NOT FRAMED YET.NOW PL. GUIDE ME WHAT TO DO,AS MY LAWYER IS SAYING THAT I HAVE TO DEPOSIT RS.50,000,OR I WILL BE SENT TO THE JAIL,THANX.

You can file an appeal in the appeallate court against the order of forfeiture of the bond giving convincing reasons for your absence.

u shd give convincing reasons for ur absence and show ur willingness to attend court regularly. make an application for continuation of same bail in appellate court,

You shall have to move an application for surrender and bail before the same court. Court may send you jail for a day or two or may be more and can cancel its earlier order subject to convincing reasons mentioned in your application.

One thing you should keep is mind that courts should not be taken as for-granted and being an accused, you should regularly attend the court and should not give any reason to yourself or your brothers to face the wrath of the courts.

In stead of moving any application before the same Magistrate to run the risk of getting arrested again I would advise you to move petition for anticipatory bail so that the bail may be granted on fulfillment of some condition. At least you would be spare from getting behind the bar.

File a fresh bail application along with fresh surety before the same court showing some genuine reasons why you remained absent.
