tenant has filed a permanant injunction suit against landlord. lanlord is in USA FOR BUSINESS PURPOSE. LANDLORD'S WIFE HAS POWER OF ATTORNEY IN HER NAME REGADING PROPERTY IN ISSUE. CAN SHE APPEAR IN COURT ON BEHALF OF LANDLORD BY FILING POA.

Yes. The Power of Attorney has powers to represent the principal in the law suit and even appoint lawyer for legal representation in the civil suit on behalf of the principal. The POA should be duly signed and authenticated for this purpose. The POA issued from foreign country are duly notarized in the foreign country and authenticated in India by the district office where the named attorney live.

The wife of the petitioner (on the basis of power of attorney given to her by her husband) will be in a position to submit /file papers/documents as may be required in the case to the Court.
HOWEVER, SHE WILL NOT BE PERMITTED TO APPEAR AND ARGUE THE CASE HERSELF. She has to engage a lawyer for arguing the matter.

The POA wife appointed by principal husband to represent him in court may appoint a lawyer to file Vakalat and POA to represent her husband principal in legal matters before the court etc but it should be duly duly signed and authenticated of which former may be d9one in the foreign country through a foreign notary and Authentication can be done at the District Office where POA, wife resides.
