Under Indian Law, agreement does not always mean written agreement, and it can be verbal too. But in such sensitive matters like separation it will be good to reduce into writing, and if it is verbal, make it in the presence of some close family members.

There is a provision in law for judicial separation which is legal an binding on both the parties. If both the parties agree for mutual separation, why dont you approach court with a petition for judicial separation, this will save not only the marriage but also the other problems that may wait in the queue.
