Stemp duty on mortgage deed

In Gujarat state registration of mortgage is compalsary. What is stamp duty on equitable mortgage deed?

Stamp duty is not same in whole India.

In most of the states there is no stamp duty on equitable mortgage. You can confirm from local lawyer in your case.

the querist says that in Gujarat registration of mortgage is compulsory. He did not specify whether it is equitable mortgage or legal mortgage. Hence the suggestion that no registration is required for equitable mortgage, perhaps may not be solution for his query. Even in case of equitable mortgage, in many States recently a letter is being sent to Sub-Registrar stating that the title deeds are deposited for obtaining loan by the mortgagor and acknowledging the title deeds by the mortgagee, for which payment of registration fee (as per separate schedule0 is required to be paid.

Stamp Duty/Registration rules differ from State to State. The author can contact Sub-Registrar Office for this purpose.

In general the equitable mortgage deed is not registered in most of the states, however if it is compulsory in Gujarat State, you may clarify the stamp duty payable by visiting the local SRO or by browsing the department of registration site meant for it.
