Pre dating agreements

(Querist) 09 May 2014 This query is : Resolved
I have another question related.

if there is no stamp paper invovlved, can a commercial document be preated.

For example, can the parties at the end put 8th May 2014 as the date, but at the start of the document say, "that this agreement is made on 1st January 2014. Is that possible. If yes, what is the extent???

Can such documents become admissible by payment of stamp duty with penalty later?

Yes, that can be done.

Because the parties hereto have ALREADY agreed TODAY that a certain thing was agreed upon previously. There is no illegality in it up to this extent.

Sirs, many thanks for you reply, but what if I want to execute paying stamp duty. Will it possible then. Two Questions

1. Can I take buy a stamp paper dated 8th May 2014 and then say "that the agreement is made on 01 January 2014"

2. In case the document has to be produced before court, can i pay penalty and make it admissible.

I agree with the views expressed by expert Mr. Jahangir on the subject and in my opinion, the author's subsequent query too has the same answer and resolves her queries.
