Election duty- disabled person

(Querist) 22 March 2014 This query is : Resolved
I , have send a mail,to District Election Officer through which I have requested to exempt me from Election duty,as i am a disabled man, but , by not getting any reply I personally went to District Election office(pp section) on 20/03/2014, to submit my prayer(submitted through BM, SBI-Uluberia), but I was unable to get a receipt copy against the said application from the PP section. My BM has send a registered letter to DEO- howrah by requesting to exempt me from election duty. But till to date no reply from Election office. Tomorrow 23 March i am ordered to go for training for polling officer. No reply has come against my email ,to DEO- howrah. In between i send a email request for cancelling my duty, to Election commission of India. The reply came from them within 02 days. The commission said that for cancelling my duty i should contact to DEO-Howrah. But no reply from the Howrah District Election Officer. I am unable to do the Election duty due to my Spinal Chord Damage(Disability-50%). I will not join the training as well as Election duty. Please suggest me, sir.

Delhi High Court ---Don't force women, disabled teachers into poll duty.
PTI Aug 13, 2008

NEW DELHI: The MCD and the Election Commission (EC) were today asked by the Delhi High Court to consider pleas of women and handicapped teachers seeking exemption from election duty.

In an interim direction, a Division Bench comprising of Chief Justice A P Shah and Justice S Muralidhar said "The respondents (MCD and EC) are directed not to insist any woman and disabled teacher for election duty till the court's further order and consider any application filed by them for exemption from such duty."

File a Writ Petition in High Court with Medical Certificate for exemption from election duty.

If the election office is not hearing, writ petition is the avenue left. Your Branch Manager should personally try by going to the concerned election office.
T. Kalaiselvan, Advocate (Expert) 25 March 2014
As properly advised by experts above, you may file a writ petition before high court seeking exemption from election duty immediately.
Sudhir Kumar, Advocate (Expert) 05 April 2014
the writ will also lie against you department who sent your name despite disbility.

If your deptt provide a relieve the duty can be easily cancelled without going for writ.

The proforma sent by EC contains remarks column. Did you report there that you physcally unfit?

when you went to election office, did you met DEO?
