Can i file ni138 case

(Querist) 14 June 2013 This query is : Resolved 
I have filed NI138 CASE AGAINST a person in 2011 for Rs.8L later he came under MOU taken on non judical stamp paer that he will pay 8L + interest for Rs.2Lacs on equeal monthly instalment. he has cleared the Principle amt upto 6 lacs

But when we deposited 2L interest chq it got bounced. currently he is not ready to pay the interest Amt 2Lacs

my query is can I send NI 138 notice for this chq & later file the case.


there would not be any problem in my current running case.

pl suggest.

If the accused persons is ready to pay you the amount of cheque then why to go for 138 NI Act?
