sir police has arrested accussed o has not commited an offense but instead of that accussed his elder brother arrested by the police whoes name is not in the F.I.R in the case of Rape, Infact it is very sad do say that the origenal accussed whoes name is given in the FIR is just 9 years old and whole FIR is lodged by the malafide intention therefore i need that judgment. I read somewhere the judgment regarding illigal personification in the case of Bhajanlal v/s state of punjab GLH 2006(1) 780 but right now this judgment is not available to me i searched everywhere.
