Sir, can husband files a petition of Restitutuion of conjugal rights, at present he is put on trial under section 498A slapped by his father in law on him.

Ans- Yes, why not? A case u/s.498A pending is no bar to file RCR.

While the pendency of RCR is no bar to the filing of RCR, I proceed to add that RCR would not help the plight of the husband in any manner whatsoever. It is a big waste of time and money. RCR can never mitigate the sufferings of a husband, more so when he is already standing trial under 498A. It is better to contest 498A on merits rather then to compound the misery by filing RCR.

Yes,he can file RCR.

Filing RCR does not help his cause now as 498A is already going on and DV Act to follow.

498A. Husband or relative of husband of a woman subjecting her to cruelty, shall be punished with imprisonment for a term which may extend to three years and shall also be liable to fine.

So now where does RCR stand,waste of time and money.Better contest 498A on merits.
