hi,
question is hoe do we validate merriege between first cousins.
i.e
father's sister's son &
father's daughter.
in customary law chapter 7 there is aprovisin that u may marry first cousin .
but how we prove in court. is there any case law?
where the bridegroom is a NRI indian.

Customary law has no application now especially for non ST communities so there is no Indian law to help you to deal with this situation.

Customary law do have application but it needs to be proved beyond any doubt.'
In South India this type of marriage is very much valid.
Even an ex telecom minister from Southern India married his own Mama's daughter.

Marriages are not allowed in Prohibited relationship, except in rare cases when party proves custom from very long time (say last 200 years,) and continue as on today. Applicable for their community, caste , and their locality only.
In south and also in Maharashtra, few non-Brahmin community allow to marry maternal cousins.[only one couple per family]

The practice of marrying maternal cousins is still in subsistence in many parts of India. If you are able to prove that yours customs, under which the marriage between cousins took place, is very old, then then the marriage can be considered legal and valild.

Yes such marriages are practiced in many parts of the country, especially in the South India and these are valid also.

I do not kanw about chapter 7 in Customery Law. Even I do not know that where the Customery laws are written.
Please let me have some more knowledge.
