Sir,
I have a crpc 498A & 406 which was filed in women police station by my ex-wife were she failed to produce the Voucher of the belong which she has given in 406. final 498A & 406 culminated into challan which is pending in CJM court,were my ex-wife has give a list of belongs even though she has taken all the gold with her & some minors electronics items r at my home which i have also mentioned in my Divorce deed & i also requested the lady to take them but she refused ,Now she is using some influences in Women commission & get one recommendation r other,Now recently she has take a recommendation for recovery of her belong to the District SP,even though she has take all gold with her.Now my submission is can police take any action as 406 is pending in the court,

since the matter is pending based upon the same incident there cannot such action be taken.

matter is still subjudice before a particular court, no other commission or quasi judicial body can interfere now.

I am not worried,what i am worried is the harassment which police do without any reason,as i have seen that through my 498A & 406 case in Police Station .That is why i asked can police take any action?As my lawyer said police cant do anything as 406 is pending in Court.But they have got recommendation to IGP for recovery.

Depend upon the party's management and the pressure on police.
Meantime if you are afraid of the police action better tell your advocate to manage for ACB and Police.

ACB ? I am already on regular bail for 498A & 406,which are pending in CJM court.I am asking for advise that can police take any action when RPC 406 is pending in Court.As my ex-wife have got recommendation to IGP for recovery of ornaments & belongs from Women commission.

Without the order of the court i.e. by way of search warrant issued by the Court, the Police Can not do anything.
