Sir,
My mother had self acquired 2400 sqft of site with built house. one year back she made gift deed for 1600 sqft to me . now she is suffering from cancer, she wants to give the rest of property to me. She cannot go to register office. can she make a WILL even in this medical condition. will it stand if my sisters challenge it.

Pl answer my doubt.

Yes she can execute the Will if her mental condition permits her to understand as to what she is doing. But if your mother can not move then you could apply for Commission whereby the Registrar would come to your house for the purpose of completing the Registration.

For a valid will the testator's mental condition is important. You can take a will and get it registered as suggested by Mr.Barman.

In addition to the above suggestion, I have to say that before signing the said will you must get a medical certificate from your family doctor or doctor whose treatment is given to your mother "that your mother is mentally fit to understand the content of the said will or the said transaction".
