Rejection of b-report on the basis of additional fact possible?

(Querist) 03 August 2014 This query is : Resolved
Ld Counsels,

Wife got an FIR registered by police by moving an application u/s 156(3) CrPC for offenses u/s 417 and 506(ii) of IPC, husband misrepresented property status and threatened for money after marriage. Police filed a final report holding the complain as mistake of fact due to adverse finding by civil court.

In the mean time wife also came to know about the extra marital affairs of husband.

Can the wife get the FIR re-investigated by filing protest petition in view of additional fact regarding extra-marital affairs found after the registration of FIR?

Thanks in advance

Instead of protest petition, let she file a fresh complaint on the latest offence committed by her husband.
