Can a registered housing society construct a small garden in its open space without conveyance of land in its name?

society is constructing garden in "ITS" place for the use of its members then why any conveyance is required.

If the portion of land is reserved as open and common area as the approved plan of the society building, then the society can build a garden over the same by passing a resolution with the members and filing an application before the registrar of the societies.
