Guest (Querist) 05 April 2017 This query is : Resolved
after death of my father , his FD documents are stolen by someone nearest. now what should my mother do.
Sudhir Kumar, Advocate (Expert) 06 April 2017
what bank has said.
Guest (Querist) 06 April 2017
its SBI. For the time being we gave application and FIR copy and my mother's ID card and applied to keep account on hold. we know the culprit also but culprit has hired one locker somewhere in South Indian bank and told us that she doesnt have any documents with her.
Adv. Yogen Kakade (Expert) 06 April 2017
If the FIR has been lodged, the let the police do their work and investigate the matter. Merely loosing the FD documents does not amount to loss of your right over the deposits. Don't worry. Apply to the bank authority with all the relevant facts and wait for the reply.
Rajendra K Goyal (Expert) 06 April 2017
FD is non transferable document, proceeds would be given to account holder or after him to nominee / legal heirs. SBI would issue another copy of the FD after obtaining un-stamped indemnity bond and application. All legal heirs can apply to Bank for proceeds if no nominee exists.

Certified copies of the property documents can be obtained from registrar office.

Why to repeat?
Sudhir Kumar, Advocate (Expert) 06 April 2017
you now said

"ts SBI. For the time being we gave application and FIR copy and my mother's ID card and applied to keep account on hold. we know the culprit also but culprit has hired one locker somewhere in South Indian bank and told us that she doesnt have any documents with her. "

now you have shared the facts that

(i)ts SBI.
(ii) we gave application and
(iii) FIR copy and my mother's ID card and (iv) applied to keep account on hold.
(v)we know the culprit also
(vi) but culprit has hired one locker somewhere in South Indian bank
(vii) and told us that she doesnt have any documents with her.

what prevented you to share these facts earlier?

do you think you are taking exam of the experts?

do you think that this forum is solving riddles?

do you think you will not get a wrong advise if you hide facts?
Sudhir Kumar, Advocate (Expert) 06 April 2017
you are still not sharing what bank told you.
Guest (Querist) 06 April 2017
Kakade sir and Goyal sir thanks for reply. my query is resolved. and gave me immediate mental relief also.

@ Sudhir Kumar sir, why someone wud dare to test experts. This website has u all experts to help us. Why we we wud waste their time.

As the event took place last week , we are also getting info slowly . I shared : "Bank suggested to keep all the saving accounts on hold " . We did not discuss that tm about FDs bcz mother was not well.
Sudhir Kumar, Advocate (Expert) 07 April 2017
You did not discuss the FD matter with bank and expect this forum to advise you on behalf of bank and better than bank?
Kumar Doab (Expert) 07 April 2017
If the person that has stolen FDR docs is Nominee then it can stake claim for payment.

You may need order from court to stop payment.

"Bank suggested to keep all the saving accounts on hold "

It is believed that it is not in writing.
Kumar Doab (Expert) 07 April 2017
Author has deleted the a/c.

first file FIR enclose copy with application to bank. Bank will suggest u to complete some set of documents. Execute them as per their instructions.
