Builder sold land owner share

sir,

land owner and developer executed a development agreement cum gpa.

the builder have only 60% share and land owner have remaining 40%.

land owner living in usa.

builder sold away the including land owners share.

how to take action.

The landowner can take the builder to consumer forum and seek compensation , share in profit and damages.
He can file case of cheating and fraud as well.

A civil action would be a better course.

Civil action can be taken as per terms of agreement.

Criminal action on the basis of fraud and cheating can also be initiated.

SINCE THIS IS A MATTER RELATING TO TRANSFER TITLE OF IMMOVABLE PROPERTY AS WELL AS VIOLATION OF AGREEMENT , CIVIL SUIT IS TO BE INITIATED AGAINST THE DEFAULTING PARTY AS A PROPER LEGAL RECOURSE.
