I am married and living separate from my husband since last one year and having a son. I want to file a case for maintenance as he is not giving anything to me or my son. He says that he will give divorce by mutual consent only when he won't pay anything to me/son.

if i file a claim for maintenance, how much time does it takes for final decision?

u can file maintenance petition under section 125 cr P C along with u can also filed petiton for interim maintenance application . the court can decide interim maintenance within short period and your husband has to pay the interim maintenance till disposal of final maintenance. or you can file petition under Hindu law of maintenance also depending upon status of your husband

You may file a petition before family court u/s 125 of Cr.P.C. for maintenance along with an interim application for the same and same will be decide by the family court within six months.

if u file maintenance petition in court then u will get interim maintenance within 4 months and final order will be passed by court in 2 years time.

You may file a maintenance petition u/s 125 cr.p.c and also an interim maintenance petition under the same provisions. Once in he court, he will not find he reasons to repudiate your claim.
