Hello Sir,
I am going through very stressful life,pls help me,my problem is - We are 6 member's in a family [me [boy],father,mother,3 sister's (including 1 illicit sister) , 2 sisters married (including illicit sister) ],My mother [unfortunately],had illicit affair with tenant around 30 yr's back through which she has illicit girl, my Q's are -
1.My illicit sister [married]has any right for my father's property ?
2.Me & my father know that we have illicit member in a family but due to 'SAMAJ AUR BADNAMI KA DARR' ,we are going through 'MENTAL TRAUMA',can I lodge a fir against my mother & tenant ,to punish them ,is there any law for it ?.......Please reply ASAP..THANKS...

yes she has right over your father property . dont ruin your relations with your mother . the fact that your father accepted her as his daughter and gave her his name entitles her to share in father property .
your father can of course make a will and not give your sister any share in his property ....

The alleged illicit sister was, apparently, born when the marriage of your parents has been subsisting. The law presumes your father to be the father of that girl also. that girl is your real sister.

1. The fact that the said sister also will share your father's property has trigerred your this query,
2. So, if she can be deprived of her share of your father's property, Justice will be done to your father or his emotion will be satisfied?
3. Your father could have taken legal action against your mother but your sister has not done any crime to be deprived of her share of your father's property whom she and the society knew as her father all through her life.

As rightly observed by expert Mr. Ganguly, a share in the property to your half sister is an eye sore to you, i.e., if she will be deprived and denied the privilege of share in the property, you will become peaceful and your father's name and fame will remain in tact (?), it is your mother who has to be blamed for her illicit affairs with another person while she was married to your father and not the kin born out of such relationship. If you have send your half sister out of home, first you send your mother out of the home. Can you do that?

In view of the provisions of Section 112 of the Evidence Act, the girl in question is not the half sister, but stands in the same footing of legality as to parentage as any of his other siblings or the queriest himself.
I am afraid the members of this forum would be inviting a huge burden on themselves if we venture into questions of morality raised in connection with private affairs esp. parentage.
