National paid holidays

I would loke to know that as per the provisions of which Act 26th January, 1st May and 15th August are declared as National Paid Holidays in the State of Maharashta? What are the other relevant details regarding teh same?

Three national Public holidays Independence day, republic day and Mahatma Gandhi birthday.(15 August, 26 January, 2nd October)

You could have mentioned what is this establishment; Commercial, Factory……………………….!!!

In state of Maharashtra it is as per : Bombay Shops and commercial establishments Act. Sec: 35(4)…………………….You may also refer to Sec: 2(11) , 18,


In case of Commercial establishments i.e. banks to which ‘The Negotiable Instruments Act’ is applicable, declaration of these National Holidays as paid holidays is mandatory.


{ In many states e.g; Karnataka, Kerala , Punjab, Himachal, Orissa, Andhra, etc. the state govts have enacted the National Festivals and Holidays Act and the above mentioned holidays are applicable as per this Act.}


In case of Factories : There is no such provision, except in cases where it has been added on holidays list in the past, followed for years and has become a long standing practice, usage and custom.
Thus if it is a new factory it may not be mandatory.


Still thru agreements between management and workers' unions, paid holiday may form a part of the holidays. But Observance of National or Religious holidays may not be mandatory included in the list of holidays as per the agreements.

These holidays can be selected by the parties in agreement.

Although academic problem, but well advised. As a Sr. Manager, you are expected to know that these are not Maharashtra state's national holidays, but are the national holidays for the whole of India and if any worker is called for duty on these holidays, day's additional wage for daily rate workers or double the rate of prescribed OTA to the regular employees has to be paid to them.

OT+ compulsory one day paid holiday on next wednesday, and or any day, within 10 days, to adhere to {no continuous 10 working days at a time.}
