Non registered agrement

(Querist) 31 August 2013 This query is : Resolved 
I am the forth owner of a flat in Thane, Maharashtra. The 2nd agreement for sale made in 1996 of the said flat is not registered. But the stamp duty is paid for the same. Now how can i register it?

An agreement made in 1996 can not be registered now in year 2013.The seller should be approached for a fresh deed with competent recitals to bridge the gap and legal lacunae created.

section 23 lays only 4 months time for registration of a document from it's date of execution.Facts stated does not fall even under cases of exceptions covered by sections 24, 25 and 26 of the REGISTRATION ACT, 1908

for resale of flat registration is not mandatory requirement . however if you had taken a bank loan then bank would insist on registration . you cant register document now after 16 years

So you are not owner.


You have to approach the last registered owner and why should he agree to cooperate without having received the difference of price escalation during the period.
