Society charges (rented falt)

Sir, Pls guide,

A has taken a Rented Flat vide L & L Agreement (Rent Rs. 70,000/-). Licensee is paying Rent regularly.

Owner is paying Society charges since seven months it is included in Rent amount. And Owner has promissed that he will bear Society charges since is it included in Rent Amount.

Now Owner want to sale the said Flat. And Licensee want to vacate the house but owner wanted Society Charges which was paid by him for seven months.

Note : there is a clause in L & L that society charges shall be paid by Licensee.

Kindly guide what should Licensee do.

If you have agreed to pay the society charges why are you trying to avoid them now? You want to vacate also. Then you have abide by the contract.

We can not suggest you to do anything against your act.

It is for you to think of alternatives and decide and you will not get legal protection, though you may take some undue advantage.

Licensee can always vacate the flat if he does not wish to pay the society charges.

As per agreed terms of L&L society charges need to be paid.

Agreement shall prevail and thus licensee shall bear the society charges.
