If in a case court fee affixed is less and he other party raises preliminary objection for the same, will court dismiss the case or give opportunity to affix defficient amount of fee.

Court will surely give opportunity or even you also pray for such liberty to file deficit stamp duty.

Opportunity shall be provided but prior to that both parties shall be heard and it shall be concluded whether the court fee is really deficient and if so, how much additional stamp duty/court fee is required to be affixed.

First the court will decide the issue of valuation.In case court finds suit under valued it shall ask plaintiff to amend the valuation clause of the plaint,after amendment is carried out by plaintiff,court munsrim(registry of court)shall report about the deficiency of court fees for payment where of court shall order & you shall pay.
