(Querist) 03 December 2012 This query is : Resolved 
Dear Experts,
I want to let out my apartment for a continuous period of 5 years to my friend and thus would like to execute an agreement with him. The apartment is in Kolkata. Now, according to sec-17 of Registration Act, 1908, Lease Agreement greater than 11 months, shall have to be registered.

Now, what sort of agreement, should I choose (e.g. Leave & License or Tenancy agreement) , so that I don’t have to register the property with the Registrar of Assurance, Kolkata. If not, what should I do.

go in for leave and license agreement for33 months with renewal clause . have the agreement regd . it protects your interests

Thank you, but is it mandatory for a leave and license agreement of 33 months with a renewable clause ( say about of 2 terms of 33 months each) to get register?

Leases of immovable property from year to year, or for any term exceeding one year, or reserving a yearly rent is required to compulsory registration.
