(Querist) 23 February 2012 This query is : Resolved 
sir,
as i written earlier, i had to take the summons from the police officer and appears to the court on 28th february with my parents.
sir the cases on me and my parents are:
498, 306,114,506,dp3/7

we had taken bail on 18.05.2009
sir, now what we had to do ?

should we had to took bail again????

should we file quesh or discharge?

althogh we are on bail from last 3 yrs and now the case will start on 28th feb.

No you wont need to take bail again if it has already been granted in the same case. The case would now start as chargesheet would have been submitted.

You don't need to get bail again, Now since cognizance of the matter is taken by the magistrate - it's a crucial stage - you'd get to argue on charge - if the charge appears groundless the court can discharge you, You can also go in for quashing of FIR u/s 482 CrPC - on certain grounds - to illustrate : if the allegations in teh FIR do not constitute any offene whatsoever

You need not take fresh bail rather trial shall start now and charge-sheet is going to be filed on 28th Feb so your presence before the trial court is must.

fresh bail is not needed...simply proceed with the trial if the charges are framed.

consult your local lawyer, if there is some scope for quashing of FIR then may take a remedy before Hon'ble HC

and if there are some chances of compromise then its better to act in that direction.

Your options are to face the trial or go for quash if grounds are there or to negotiate for compromise.
