Perjury

Querist : Anonymous (Querist) 29 January 2012 This query is : Resolved
I shall be grateful for proper guidance:-
My brother and I don't share good relations. We both have our respective shares in the property but I've had to file a couple of court cases against him regarding property for proper succession proceedures as per regd will.
Our father passed away 10 years ago. He has admitted the Regd Will in these court cases. But clandestinely he colludes with my ousted sister so that the effect of regd will gets diluted into intestate. What should I do?? The couple of court cases are still going on.
With respect to all of you experts.
I've heard of 340 Cr.P.C read with Section 191 IPC etc. Please guide more in detail.

you have stated that your father left behind a registered will and there were number of court cases with your brother .

did you apply for probate of will . probate is judicial proof of will .

we do not understand how effects of regd will gets diluted into intestate .

get probate done if you fear your brother is creating problems .

You have failed to put the entire relevant facts here without which it is impossible for any lawyer to guide you properly.

It shall be better if you consult any senior civil side lawyer with your entire documents and precure his advice.

You have to fight that allegations and prove the Will.
If you could do this then nothing to worry much.
However the sections you mentioned is not applicable in the present circumstances.

You need to prove the Will instead of thinking of perjury. The party contesting with you has right to to deny your case.
