This query is : Resolved
I an working as a General Manager (HR) in the State PSU. It is a solitary post created in the Headquarters office of the PSU in the year 1990. The PSU is having territorial Zones and under Zones Circles are there. All my predecessors worked as GM(HR) at the Headquarters office of the PSU. I am also working as GM(HR) of the PSU at Headquarters office of the PSU. Now my post is at Headquarters office and orders are issued in writing to me that I should be stationed at Zonal Office, which is away from the Headquarters office and to look after the works at Zonal office. The post from Headquarters is not diverted along with the incumbent. The post is at Headquarters (I am drawing pay and allowances at Headquarters pay drawing unit) and however working at Zonal office. This is done to create humiliation to me as I am not dancing to the tunes of CEO.
My query is a solitary post created at Headquarters office in 1990 for the sole purpose of discharging duties at HQs office and the person presently working in the said post can be asked to be stationed at Zonal office. Is there any way to challenge this as it is causing humiliation to me.

Dear Anonymous,
It is not the question whether the post is solitary one or one of the multiple posts of similar nature if the headquarter is changed. On that point an employee, irrespective of his status, does not have any say if done by observing due process by the competent authority.
However, if the post is deiverted along with its incumbent and the headquarter is changed without Board resolution and without issue of subsequent formal orders for diversion and transfer, etc., that is irregular on the part of the CEO and you can go to the court of law for justice.
BUT, before filing any case in the court of law, you may please better double check the delegations of the CEO provided in the Memorandum and Articles of Association or by virtue of any Board Resolution in that respect to verify whether or not the CEO is empowered to shift headquarters of the incumbent of HR and also with or without any formal order. This may help you taking a proper decision in this regard and to prove your point in the court of law.

Mr.Anonymous,
Which kind of coward are you?
That you are not mentioning your name or name of PSU & of which state?
This shows your incompetence as GM (HR).
Can you tell me your educational qualification?
You must be possessing service rule book,go through that you will find the rights and responsibilities of the CEO.
Then decide how to take legal action.
