consumer protection act and right to information act

(Querist) 15 June 2011 This query is : Resolved
Can someone give me list of all judgments which states that applicant of RTI pay fees of Rs. 10/- as cost for service and hence matter pertaining to RTI can be dealt with Consumer court.
Devajyoti Barman (Expert) 15 June 2011
Matter pertaining to RTI is not amenable to Consumer Protection Act. By paying Rs 10 the applicant is not hiring any service.
PALNITKAR V.V. (Expert) 16 June 2011
I also did not come across any such judgment. But I am of the opinion, that should come under the term hiring of service. I have an example. one of my friend applied for copy of a document. The dept asked him to pay the charges. he paid but received a wrong copy. this happened thrice. Is it not deficiency in service?
mahendrakumar (Expert) 16 June 2011
yes,one can defenitely file case under consumer protection act.

there are many consumer judgements.

recently there was a judgement by the vijayanagaram consumer court.

earlier there was a land mark judgement by the national commission in Dr.SP Rao v/s Mysore municipality.

above is the link of judgment referred by my friend mahendra kumar.

it is quite an interesting judgment, a must read judgment.

those who are aware of the Telecom judgment shall consider this judgment in that context also, the reasons given by the NCDRC effectively apply to telecom disputes cases also.

Though I still dont agree with this judgment, with regard to RTI matters, but its a good judgment to be discussed.

waiting for opinions of Mr. Barman and Mr. Palnitkar :)
PALNITKAR V.V. (Expert) 16 June 2011
Thanks for the judgment. I had already opined that the Act should be applicable to RTI authorities. I fully support the conclusions and the reasons too!

Mr.Kiran Kumar RIGHTLY SAYS "it is quite an interesting judgment, a must read judgment."
