Iam deserted by my husband & inlaws, They have harassed me alot, but still i have feelings for my husband and want to patch up and i have tried alot, reconciliation but my inlaws and husband didn't cooperate. So now i have filed a case for maintenance against my husband, under section 125 crpc.
But now my husband called me and threatened me that he will not give me a single penny, because he have seen my smiling and happy pictures on orkut & facebook. He says that even after being deserted if you are happy and clicking photographs that means you are happy so court won't grant you maintenance,you won't get any relief from court.

my question is it true ????

No. It is not true. No court will expect or want a deserted wife to put up wry face for ever and keep weeping. Dont believe all these.

yes. The court considers only the income issue of both the parties , not their pictures in orkut or facebook.

Your husband is playing mind games. As Mr. Barman has rightly told you, court is going to consider only earnings of both the parties.

Thankyou so much. Iam not earning a single rupee, iam studying, i have joined a masters course for a good future,to help myself. Presently iam living with my parents, at their house. My father is 61yrs old, has joined a job, after his retirement. so iam completely dependant on my father. And my husband is not supporting me at all. So this is the reason i want maintenance from my husband, as he is not accepting me back.

yes. under Section 125, it is enough to prove that you are unable to maintain yourself and he is neglecting to maintain you having despites having sufficient means.
