Getting patta for undivided share in land

A person sold his land to two person. 1200 to first person and to My father 600 sqft as undivided share. Both of us built individual house and were residing for more than 20 years. Is it possible to get patta. Plz suggest.

First requirement for the patta is to get the partition of the undivided land. Once specific share comes to your share, the desired action can definitely be initiated.

What is the necessity of getting patta? Did the seller not have title to the land?

How much extent had the seller? My understanding of the query, the total extent might have been 2000 sq.ft. and the seller sold in two un-divided shares. If the seller mentioned in the document that 1200 sq.ft out of 2000 sq.ft to one person and to your father 600 sq.ft. out of 2000 sq.ft.. If it is mentioned like that then apply for mutation of patta.

Patta is generally given for vacant site or land only and not not for the constructed property.
Since both have purchased the property from a single owner with undivided share in it, a partition deed may be drafted and the same may be executed by a registered document which will solve the problem.

I agree with Mr.Kalaiselvan expert view. I may add, undivided share normally applies for co ownership of all piece and parcel of land to have common enjoyment. From your statement both have developed property of your own. If no common pathways or common area, you can apply for sub division through a settlement deed between both owners in consultation with legal expert on property matters, get it registered and go for putta transfer. You can perhaps consult Revenue officials before doing the same.
