Release deed

Sir/Madam -

In 2002,I had paid and brought land in AP. As Iam deaf and busy with office work at chennai, My father registered land in his name. My father died in 2006 and the property is in my father name. I would like release deed from my mother and younger sister to release their property rights in my favour so that I can sell property on my own in future.

Please let me know the solution. Can I get help in writing release deed ?

Get a gift or release deed executed in your name by the other legal heirs left by your father.

you have to get it drafted by a lawyer .stamp duty is nominal if done in favour of relatives as in this case .

First of all get it mutated in name of your father's heirs as your father has not left any Will in your favor.There after get a release deed drafted by a lawyer,pay stamp duty as prescribed in state the property is and get the release deed accordingly registered.Stamp duty differs from state to state and can be confirmed locally.Ready made drafts may prove fatal so we discourage them.

Sir -

I had legal heir document drafted and stamped by notary (lawyer from AP High Court) in 2006 the year my father died. Is this document which is same as what you said as "first of all get it mutated in name of your father's heirs"??

Iam in Hyderabad and I wish lawyer support in getting the release deed drafted and executed. Please help me the same. If possible, online support and send/receive documents via email and guidance.

No! That is not what I said.

After your father bought through sale deed the record of right in whose jurisdiction the land is must have gone changed by expunging the name of seller of your father and substituting the name of your father and you yourself state that currently land records are in your father's name.Now all heirs of your father(his mother,if alive,and widow,and all children male or female,who survived your father)needs substituted in record of rights of the land.

If the land is agricultural generally mutation is moved before Tehsildar/SDM. Otherwise it may be municipality or Development Authority of the area in which land lies.Unless you get this mutation done
the sub registrar would not be able to ascertain shearers and their respective shares to be released in your favor and even valuation and ascertainment of duty would also be not possible to be made.

Thanks a lot sir. This land is brought from VGTM-Urban Development Authority. Shall I go to VGTM-UDA office and get this correction done in my name and again register - I mean seller (VGTM-UDA) and myself by showing valid proof Myself as son of the father who died ? My mother and My sister has no objection on my moves.

Yes! now you have understood.They might be having some standard format of mutation to be filled by you. NO OBJECTION might also be in standard form of affidavit you would need to file separately signed by your mother and sisters.
