This query is : Resolved
Ten month back on first date of a criminal proceeding in court the complainant submitted some incriminating material regarding a subsequent criminal offence commisioned by the same criminal offenders. The magistrate has ordered the concerned police to “verify the fact and do the needful” on the petition containg those facts and documentary evidances attached.
My query:-
1. How to get the action taken report by the police on this order of the magistrate?
2. Whther the complainant/petitioner can directly plead before the magistrate for an order to the concerrned police for the submission of status / action taken report in the court?
3. Or whether it is must to engage a lawyer for the said purpose?
4. Whtherther this order will be read as order u/s 156(3) or u/s 202 of Cr. P. C.?

I agree with Ld. Arunagiri, it is a matter where facts needs to be told, before any suggestion can be made.

1. Move an application under section 173 (8) of criminal procedure code and get the desired information.
2. Yes. He can if he has not engaged any counsel to plead his complaint.
3. No.
4. It depends upon the order of the trial magistrate but if the magistrate has ordered to produce its report then it shall be treated under section 202 of criminal procedure code.

@raj kumar makkad
As per my knowledge, the section 173 (8) of Cr. P. C. is for further investigation of the case.
