Landlady is threatening to disconnect the electricity

I am staying in a rented apartment in Gurgaon and due to earlier non cooperation by my landlady a deadlock exists between us.

I have paid my electricity and maintenance dues to the Management Committe of the society where the apartment is located, however, as there is a deadlock I have stopped paying the rent for the last two months.

In light of the above, can the landlady pressurise and force the management committee to disconnect my electiricity supply which she is threatening to do so. If no, then what steps can I take to safeguard myself.

An early reply will be highly appreciated.

Whatever may be, one cannot disconnect the water supply and electricity without due process of law.

You can restore the amenities through a court order. You can get the interim order in a single day, if you engage a smart advocate.

If you keep on withholding the legal agreed rent, you cannot expect all god's behavious from your landlady. She may go to soceity and can disconnect it. Though you may go to courts thereafter and meanwhile you may suffer for all sufferings. Immediate restoration is not possible. So it is advised to first clear rent arrears.

Yes am also agree with makkad sir.. Clear your arrears of rent. She not ready to recieve it mean sent it through money order. Then you can approach court for your remedy..

Rent you have to pay and since it is society to instead of any legal course take help of management body. Cutting of electrical supply is criminal offense who ever may do it.

Yes, if you fails to pay up her the agreed rent, the Landlady has her remedy also. Therefore, please try to resolve the issues with the landlady amicably. As far as right of landlady for getting electricity connection disconnected, unless exact details like under whose name the power connection existed; who has got agreement with the Society or the Power Distribution Company; terms & conditions of the power supply agreement,etc., are known., it would be too premature to comment upon the same. Of course, if the power connection existed in the name of the landlady, in the normal course, she has right to get the same disconnected also. If you are a tenant having legal tenancy agreement with the landlady and if she get the power connection disconnected, you may make an application to the District Collector for permitting you to obtain your own electricity connection from the local Power Distribution Company concerned. However, as has been suggested, it is always to advisable to go for amicable resolution of the issue with the landlady.

Find ways to re-open the deadlock existed with the landowner and pay the arrears of rent, which will be the best option to solve the problem. Although advocates would be benefitted with litigation, be practical and avoid litigation to buy peace.

@ AA Jose - Sir, the electricity for this society if actually in the name of the Management Committee and sub meters have been provided by the MC to the occupants. The monthly electricity dues are collected by the MC and then paid to the electricity supplier. In view of this, can the landlady pressurize the MC to disconnect the electricity supply even though I have paid all my dues to the MC.

get an order u/s 144(2) Cr.P.C.Preventing your landlady from what she is threatening to do. Stopping payment of Rent is not a wise decision you can contact Rent Control Authority. For details visit www.rajarshibhowmik.webs.com
