Complaint against builder

We have purchase a flat from M/s Laxmi Global Import Export Pvt. Ltd., Mansarovar, New Mumbai. We have booked flat from Builder in Dec-10. at that time they show us a plan in which no any shopr / residential in ground floor. It is completely open for parking & playing & our booking price is fixed on that basis that we will get more FSI for use. Afterwards they have change plan with CIDO & shown a Shops in ground floor. Whwn we ask the builder for the same he says that we have use our FSI. although as per CIDCO approved revised plan ares for shop is 210 sq. feet each whereas builder construed for 280 sq. feet each. That is excess illigal construction due to which only 4 parking ares are left for 20 flats & 4 shops. Even no Watchmen's cabil & society office is built by Builder yet which he has to provide normally. There is no sufficient space for that. Also the construction quality is poor. With in residence of only 15 days we observe removing of wall slabe, craks, partly removal of MAin door frame, low quality Electrical wiring & fitting is low quality, even building finshing work not yet completed. We call builders office but they are not neglecting us. What remidies we have to complaint against builder. Pl suggest.

issue legal notice to builder . Under provisions of Mharashtra Ownnership of Flat act builder is bound to rectify the leakages , defects in quality of construction .

do you have copy of the sanctioned plans on basis of which you had booked the flat . you can also complain to CIDCo against the builder if he has done illegal construction .

Further you can file a complaint under consumer protection act for deficiency in service and unfair trade practice.

No sir we do not have any sanction copy of first plan, because we have booked the flat before bommi poojan of the land. At that time Builder has obtained a sanction copy from CIDCO for construction. Builder has shown us a colour photo copy of the building design & talk commit oraly. But we can obtain 1st Apporoved plan submitted by builder from CIDC's office on request where in this plan no shops are shown in ground floor. We first comes to know when agreement was executed in May-10 & in this agreement copy I have seen the revised plan. When my building is completed & society is form in Nov-11, I confirm with other society members also. Builder is doing tort.

You should first obtain the first plan approved on the basis of which booking was done by builder and should also obtain second plan which has also been violated by him openly and make multiple complaint against him viz. CIDCO, Joint Registrar, Consumer forum etc. and even with police authorities as he has cheated all of you and has encroached your valuable joint holding.

Your grievance could be effectively resolved by the Consumer Forum.
So do not waste time any more and file the same.
