municipality registered house in agriculture land.

Respectable experts,

Our relative build house in my grandfather agriculture land, he is not वारसदार of my grand father. He has taken electricity connection and paying local municipality taxes for the house. My grandfather permitted him verbally to do so before 40 years. The said land is still agriculture land near a town in Gujarat. Now my grandfather is dead and he wants to keep whole agricultural land of my grandfather stating he is residing there since 40 years.

Can I chellange municipality and electricity company for providing their facilities to a house in agricultural land? How?

My grandfather didn't signed any agreement with my relative. He just allowed verbally to build small house to stay because he was poor.

actually where are you from? i mean which state?

because every state has local land laws.. so procedure will be differ from state to states..

Who is shown as occupant of full agricultural land and that particular portion in the documents with the revenue authorities?

Whether the land is shown as agricultural land or residential land in record?

Discuss with local lawyer in view of the local law.

Firstly take a possession of the farm land.. and go for legal proceedings against him.. consult a local lawyer along with the available papers.. think about limitation in this case.

Land is agriculture type in Gujarat state. 7/12 and 8a of the land is in the name of my grandfather. I have asked municipality and electricity company through RTI, for the documents produced to take their facilities.

Can IPC 441 is applicable in this case in gujarat?

Yes. You can proceed by invoking section 441 of IPC as far as agricultural land is concerned. I doubt in respect of house. However, you can obtain necessary information how the municipality has given permission for construction of house on the agricultural land, how the electricity board given permission for domestic service connection etc., which may be useful in legal proceedings.
