Flat given on rent in navi mumbai

Sir,
I own a flat in Navi Mumbai. I have given it on rent in July - 2010 and since then, the same family is continuing living there. For last 3 years, there is not even any agreement between us as there is good relationship.
However, I need to know that
1. whether it poses risk of flat for me ?
2. In Mumbai, generally people change their tenant after 3-4 years, why it is required ?
3. Whether a simple notarised agreement suffices or we need a registered agreement for 11 month lease which is continued from year to year.

You must execute rent agreement between you and you tenant despite your good relations with them.

This will minimize your risk of possession of your flat from the tenant and also you can legally file or contest case if any in respect of the same.

Now relatioh is good, if it strained then there will be problem for you. So to aovid this go for rent agreement

Sir,
According to the Maharashtra Rent Act 1999, the rent and/or Leave & License agreements have to be mandatorily registered.
It will be to the best of your interests to enter into a Leave & License agreement with your tenants, as the section 24 of Maharashtra Rent Act 1999 protects an owner and assures repossesion of the premises given on Leave & License, on maturity of the License period.
whereas a rent/tenancy agreement transfers the tenancy rights to the tenant and it becomes virtually impossible to get repossession of the premises.
