POA to counsel

Sir I am complainant in a cheque bounce case and unable to appear on each and every date.Can I give general or special power of attorney to my counsel for the goodness of my case?

never give POA to your counsel . always in favour of family member . you only give vakalatnama to your advocate to act appear and plead on your behalf


you need not appear on each date . your lawyer can file application for exemption until further orders . you can be granted exemption from personal appearance

Its always better for client to attend case on date. It is to be umderstamd that you have only single case on the other side your counsel may have lots of cases incl. Your case.

The advocate is already authorised to represent the case of client vide the vakalatnama. As far as POA is concerned give it to some one else than your advocate.
If your advocate is the POA holder then who will represent him in court.

Better entrust your POA in favor to some of your near and dear. Lawyer can appear from your side due to Vakalatnama in his favor.

The counsel appearing on your behalf in the court for the case cannot be your POA too. You have to appoint another person as POA. An advocate cannot perform dual roles in the court i.e., counsel and POA of his client in the same matter before the same court.
