My Husband has taken an insurance and represented his mother as nominee (before marriage) he died i filed a suit stating me and my daughter are legal heirs .my motherinlaw died .Are her legal heirs entitled for the share in insurance .can someone clarify this to me please

A woman automatically becomes a nominee in the Insurance policies of her legally wedded husband.

Where nomination assign,any other can not person become automatically become nominee. But nominee is not owner of any such property and legal heir can claim their right.

@Mr. Koshor Mehta,
Would you please like to throw more light on automatical change of nomination by quoting authority, according to which the nomination made by an unmarried person automatically becomes ineefective and "a woman automatically becomes a nominee in the Insurance policies of her legally wedded husband?"
This would not only help the querist to win her court case, but also help enhancing the knowledge of all other community members.

Hon'ble Mr. Dhingra,
The use of the word 'automatically' is inadvertent, what I actually wanted to convey was that the legally wedded wife is a bonafide beneficiary to the exclusion of all, and the nomination is only a trusteeship.
I stand corrected and sincerely thank you for drawing my attention.

Kishor ji,
Nice of you for your clarification. In fact, nothing is done automatically, Nomination can be changed only by specific application for change by the policy holder only. Insurance company cannot do anything at its own.

All the legal heirs of your deceased husband are entitled.
