Rent act & civil procedure code

(Querist) 11 February 2012 This query is : Resolved
In 2005 SC has confirmed the eviction decree, after we filing execution tenants brother filed objections, appealed and playing around in the courts below. now tenants wife as legal heir has objected that landlord has not joined all the legal heirs in EP. (where in tenants brother appeal she only made a statement that she is the only legal heir).
The District has dismissed the appeal & even the High court has dismissed the appeal for not bringing all the heirs in EP.They are all bound by the decree. Now what is the other remedy for the tenant to delay the execution petition. he has to go to SC of a review before the HC ?

The District court & the High court both have dismissed the appeal for the heir of the org tenant against the decree holder for not bringing all the heirs in EP

legal heir can appeal to suprem court on grounds that legal heirs not brought on record . but ultimately they will have to vacate the premises

These are all technical issues but the eviction decree is unlikely to be set aside.

Tenants can go to Supreme court.

The language you used is not legal and not according to the ethics of this site as well of the status of experts.

We experts are not to help for wrong doers. You should have asked further course of action rather have asked how the legal heirs can delay the execution. First of all leave aside this negative approach and then think positively as opined by experts.
