hi all,
my mother B purchased agricutural land from y.y is a widow got property after her husband death,y has 6kids s1,s2,s3,s4,d1,and d2.while purchasing y and her s1-s4 kids signed in the deed.now her d1 and d2 has filed a parrtition case agaist B.
during the registration time we asked for d1,d2 sign for the deed since they got married before 1980 people in the sub registrar office said their sign is not mandatory.
wat is the soltn for this case, even the person B is also widow.

If {B} wants all,then she needs to compromise with D1 & D2;else she shall have to loose that much of share belonging to d1 and d2.

But, how can the sub-registrar's office say that the signature if legal heirs are not mandatory??

For avoiding future disputes, it is better to have their signatures.

The compromise by way of offering them some amount at the prevailing rates is the only remedy though it shall not meet out the legal lacuena. those daughters shall have to make their statements before the court that they deem proper the sale deed which they deem fit as they had provided oral consent to sale even their share and their mother had signed even on their behalf in good faith.
