In such a circumstances police protection available. But its available for execution proceeings only.
Raj Kumar Makkad (Expert) 02 August 2011
Police help can be granted only by Court, f it is convinced on the plea of petitioner. Ex-parte order is no bar to get police help.
dev kapoor (Expert) 02 August 2011
Agree, Mr.Makkad.
I however add....Where an ex parte ad interim injunction is granted by a court dispensing with the service of a prior notice & the Court is convinced on circumstances like..the defendant/non-applicant is mighty enough that service of interim injunction may not be possible through ordinary mode of service, Civil Court is within its powers to direct such order to be served through police with the direction that insructions are adhered to in letter & spirit.
Raj Kumar Makkad (Expert) 02 August 2011
Not like that Mr. Kapoor. What I meant to say is that police generally refuses to accompany the petitioner to execute the order of injunction so petitioner is required to pray before court to direct police authorities to execute it. Your version is something different.
