Any body can waive her legal rights if he or she chooses. If you all make a mutual partition deed where the daughter in law relinquishes her share in the property then no problem but if she is not ready then she can not be deprived of her husbands share.

Mr Prabhakar is absolutely right.your mother inherited properties from her father so she is exclusive owner of said propertyies and can gif and transfer as per her sweet will.
