Eventhough it is non bailable your uncle may get the bail, it is the discretionary powers of the court. If bail is rejected you will have to approach the Dist court.

If it is first petition you can move before sessions Court.You can also file before High Court.If it is rejected you can move again in the same Court by stating any change of circumstances.
